wanted for killing or seriously

Green. It's unclear if the two

are related now overnight at the

were in it was found in an

That's about 10 miles away from

where the shooting happened

around 7 30 last night on

Homestead near the East decks.

Now 29 year old deputy, we know

shot at least twice in the

stomach undergoing surgery

overnight now at last check this

morning, said to be in critical

condition but stable. Now, if

you have seen the two men that

we were showing you or know

where they are, you are being

told, Do not approach them

directly. Instead, you want to

call 911. That's a map there of

where everything transpired last

night just to give you some

perspective. If you're in that

area, you may have seen

something in the overnight

hours. You know, after seven

years and three murder trials,

AJ Armstrong Jr. Now a convicted

murderer for killing his parents

in their Bellaire home as they

slept when he was 16, the now

father and husband sentenced to

life in prison. With the

possibility for parole in 40

years after the ruling

Armstrong's defense team and

prosecutors spoke to the media.

The other thing is, the

prosecution knew everything that

we were going to do. Um and you

know, it's very difficult to do

it twice. It's almost impossible

evidence had an impact. In this

case. That evidence is

ridiculous. Um AJ filed a

federal lawsuit. They will

pursue that aggressively. Um And

about that play out as well.

Referring there to the matter of

someone who we believed in. A

jury just found guilty of

walking into his bedroom of his

parents. And shooting them both

dead. If that doesn't require us

to give us our all and to give a

presentation that a jury can

honor and respect. Then I don't

know what does Armstrong has

this third trial was starting,

there were a lot of questions.

What's going to be different

this time around? And clearly

they had that new blood evidence

that was found under sticker

that AJ War on his shirt when he

was being questioned. Was that

the turning point you think in

this case Well, I don't think

there's too many of us in the

criminal defense side of the bar

that don't find that evidence

suspect after seven years, um,

that Coming up this late in the

game just appears to be

suspected. And despite the John

Jordan's saying it didn't didn't

make any difference if it had

to. It's the only new element in

the case and so it had to make a

difference. Armstrong Juniors

team saying that they have filed

a lawsuit saying that that

evidence was planted if that

case ends up playing out that

they find yes. The evidence is

door for then Another Trial.

Well it appears that they didn't

object to the evidence coming in

in the in the criminal trial,

and so It won't be a direct

appeal in the criminal case on

appeal. If they win the civil

case, or they get a judgment in

the civil case that says it was

planted or something to that

effect. Then it can lead to what

we call a writ of habeas corpus

being filed. In the criminal

side. And that could lead to a

new trial. What else could be

argued in this appeal? Chris

Well, the main point on appeal

is going to be the sufficiency

two mistrials. The evidence in

this case is always been weak,

which is why they couldn't get a

conviction twice. And that that

the new blood evidence that that

that appears to be weakening of

itself. And so this case is

going to be on appeal is going

to be the sufficiency of the

evidence. Reversing a case on

sufficiency. Evidence is always

a very, very difficult thing to

do. And so he's got a tough road

to hold now on on on reversing
